As a result of the enactment of the USA Patriot Act (Public Law No. 107-56 October 26, 2001), the U.S. Department of the Treasury has issued regulations requiring U.S. financial institutions to obtain certain information relating to foreign banks that maintain relationships at U.S. financial institutions using a certification form. This certification is needed to comply with provisions of the USA Patriot Act. Under the applicable provisions of the USA Patriot Act, HSBC Bank USA are required to obtain this information from clients in order to assure that the Bank can continue to maintain relationship with clients.

Unlike the Schedule I and Schedule II banks, as a Schedule III bank, HSBC Bank USA (Canada Branch) are NOT incorporated under the Bank Act and therefore operate in Canada under other government-mandated restrictions. Schedule III banks usually operate within the country's largest cities (being Toronto, Montreal, Calgary and Vancouver), under certain restrictions mentioned in the Act. As of October 2010, there were 23 such banks in Canada.

In Canada, the Office of the Superintendent of Financial Institutions (OSFI) is responsible for administering a number of federal statutes, including the Bank Act and the Trust and Loan Companies Act, the statutes applicable to the regulation of banks and federal trust and loan companies.
